If you are a family member of EEE/EU/Switzerland, you have the right to request a shengen visa as a EEE/EU/switzerland family member.
Family members definition:
According to nº2 article 2º of guideline (CE) nº38/2004, are considered nuclear family members:
A partner from an EU citizen, with a partnership registered under the EU law, and if considered marriage-like;
Direct descendants under 21 years old or that are still dependent, the partners/wife/husband descendentes or direct ascendents that are at their expense;
Direct relatives in the ascending line who are dependent and those of the spouse or partner as defined above.
There´s cases where visa exemptions are applied to certain family members of the EEE/EU/Switzerland:
Family members with a valid resident permit in the UK don´t need Schengen Visa to travel to Portugal/Shengen Area, if this two conditions are met:
Travel with their EEE/EU/Switzerland family members to Portugal/Shengen Area;
If your UK residence card state the following:
Residence Card of a Family Member of an EEA National (on the passport) or;
Permanent Residence Card (on the passport) or;
Residence Card of a Family Member of a Union Citizen (biometric card).
However, when a candidate travels without a EEE/EU/Switzerland family member, even with UK Visa, must apply for a tourist visa, providing all the documentation required and the corresponding fees payment.
